He had been drinking with her when an argument led her to leave the house, planning to go the the house of a neighbour named Wallis. She then saw her husband about 28 yards away with a shotgun pointed towards her. He fired and the shot went into her side and arm. Mrs Wallis helped her to her feet and assisted her into her house. Her jacket was stained with blood. She was then taken to hospital where she remained for two days. Her husband had been a cripple for some time, suffering from paralysis of his arms and hands. The gun had been loaded on the previous evening. On a previous occasion when quarrelling some blows were struck. Her son Henry Gogoll, a little boy, appeared as a witness at the trial. They lived on about 30 acres in East Duneed Road (now Torquay Road) between Burvilles and Stewarts Roads, which was part of allotment M section 5 in the Parish of Connewarre, which they had purchased in 1857 the year of their marriage paying £300. A cottage with 4 rooms was erected on this block. They also owned 50 acres on the same allotment. In the 1870s together with other blocks they owned they took out a mortgage with William Schultz of Mount Duneed. The land had greatly decreased in value at the time of Gottlieb's death due to the large numbers of farmers leaving the district to take up selections in the Wimmera district. Johannah Louisa Gogoll wife of John Gottlieb Gogoll had resided in or near Mount Duneed for 28 years. On 4th October 1873 he made his will which was not signed as he was unable to do so because he had paralysis of the hands and arms and although he made several attempts to do so he was unable to write his name. He also suffered from inflamation of the lungs. Thomas Charles Harwood wrote his name at the foot of the will as his proctor and in the presence of and under the direction of Frederic Rupert Pincott proctor of Geelong and then signed their names as witnesses. Rev Peter George Jacobsen former minister of Germantown Lutheron Church, now of Horsham, and John Gottlieb Kurzmann, farmer of Bream Creek were the executors of the will. Exectutor Charles Milner farmer of Freshwater Creek renounced probate of the will and codicil for unknown reasons. |
